1. Agreement & Acceptance
These Terms and Conditions ('Terms') govern all services provided by Closet Form to the Client. By signing a service agreement, quote, or contract with Closet Form, the Client agrees to be legally bound by these Terms. If you do not agree to these Terms, do not proceed with booking our services.
2. Services
Closet Form provides custom closet and storage design, supply, and installation services. The specific scope of work, materials, timelines, and pricing are set out in the individual project contract or written quote provided to the Client. Closet Form reserves the right to decline any project at its sole discretion.
3. Quotes and Pricing
All quotes are valid for 30 days from the date of issue, unless otherwise stated in writing.
Prices quoted are in Canadian Dollars (CAD) and include applicable materials and labour unless explicitly stated otherwise.
Quotes do not include: applicable taxes (HST), permit fees if required, electrical or plumbing work (unless specified), drywall repair, painting, or flooring.
If site conditions differ materially from what was represented during consultation, Closet Form reserves the right to adjust pricing accordingly with written notice to the Client.
4. Payment Terms
A deposit of 50% of the total project value is required upon signing the service agreement to confirm the booking and initiate material ordering.
The remaining balance is due upon completion of installation, prior to the installer leaving the premises.
Accepted payment methods: e-transfer, cheque, or credit card (processing fees may apply).
Outstanding balances unpaid after 7 days of project completion may be subject to a late payment charge of 2% per month (24% per annum) on the overdue amount.
Closet Form reserves the right to pursue legal action, including collection proceedings, for unpaid amounts.
5. Scheduling & Access
Installation dates are scheduled upon receipt of the required deposit and are subject to availability.
The Client must ensure that the installation area is clear, accessible, and free of obstructions prior to the installer's arrival.
Closet Form requires a reasonable point of contact to be available on the day of installation.
If an installation cannot proceed due to the Client's failure to prepare the space or grant access, a rescheduling fee of $150 may apply.
6. Cancellations & Rescheduling
Cancellations made more than 5 business days before the scheduled installation date: deposit refunded less a $200 administrative fee.
Cancellations made within 5 business days of the scheduled installation date: deposit is non-refundable.
Rescheduling requests made more than 5 business days in advance: no charge (subject to availability).
Rescheduling within 5 business days of the installation date may incur a rescheduling fee of $150.
Closet Form reserves the right to reschedule in the event of unforeseen circumstances (e.g., material delays, illness, weather). We will provide as much advance notice as possible.
7. Changes to Scope of Work
Any changes to the agreed scope of work requested by the Client after the contract is signed must be submitted in writing and approved by Closet Form. Additional charges may apply, and timelines may be adjusted accordingly. Verbal change requests are not binding on Closet Form.
8. Site Conditions & Client Responsibilities
The Client is responsible for ensuring:
The installation area is free of existing damage, mould, water intrusion, or structural concerns that may affect the work
Walls, floors, and ceilings are level, square, and in suitable condition to receive closet components
Existing furniture and personal items have been removed from the work area prior to installation
Adequate lighting and electrical power are available at the installation site
Closet Form is not responsible for pre-existing conditions, concealed structural issues, or delays caused by conditions outside our control.
9. Warranty
Closet Form provides the following warranty on completed installations:
Workmanship Warranty: 10 years from the date of installation completion, covering defects in installation quality
Materials Warranty: Subject to the manufacturer's warranty terms for components supplied by Closet Form
The warranty does not cover:
Damage caused by misuse, abuse, or modification by the Client or third parties
Normal wear and tear
Water, moisture, or structural damage to the property not caused by Closet Form
Damage resulting from overloading shelves beyond recommended weight limits
To make a warranty claim, contact Closet Form in writing within the warranty period. We will inspect and, if warranted, repair or replace the defective component at no charge.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
Closet Form's total liability to the Client for any claim arising under or in connection with a project shall not exceed the total amount paid by the Client for that specific project.
Closet Form shall not be liable for any indirect, incidental, special, or consequential damages, including loss of use, loss of income, or damage to contents stored in the closet.
Closet Form is not liable for delays caused by factors beyond our reasonable control, including material supply shortages, labour disruptions, or force majeure events.
11. Damage to Property
Closet Form will exercise reasonable care during installation to protect your property. However, we are not responsible for:
Minor scuffs or marks on walls, floors, or ceilings incidental to normal installation activity
•Damage to existing paint, wallpaper, or finishes not attributable to negligence
Pre-existing damage not disclosed or visible prior to commencement of work
The Client should document and disclose any pre-existing damage prior to the start of installation.
12. Photographs & Marketing
Closet Form may photograph completed installations for portfolio, social media, and marketing purposes. If you do not consent to your installation being photographed for marketing use, please notify us in writing prior to project commencement. We will not include identifying personal or address information in any published photos without your explicit consent.
13. Dispute Resolution
In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, the parties agree to pursue mediation before initiating formal legal proceedings. These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal proceedings shall be brought in the courts of Ontario.
14. Entire Agreement
These Terms, together with the signed service agreement and any written project quotes or change orders, constitute the entire agreement between Closet Form and the Client with respect to the project. They supersede all prior discussions, representations, or agreements, whether verbal or written.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
16. Waiver
Failure by Closet Form to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that or any other provision in the future.
